The גמרא says כל תענית שאין בה מפושעי ישראל אינה תענית. Rav ישעיה׳לה of Prague was asked: “But what of those פושעי ישראל who do eat on יום כיפור?” The רב responded: “That is why the Torah says that one who eats and drinks on ערב כיפור, the ninth of the month, it is as if he fasted on the ninth and the tenth and there is a חזקה that the פושעי ישראל won’t forgo eating on ערב כיפור.”
