When a guest at an inn checked out and forgot his satchel of food, the innkeeper said to his wife that it looks like the food would keep for at least several days, so he’ll store it for the guest in case he returns. His wife, however, said that there is a ספק whether he will return and by now the man must have been מתיאש and so by now it was הפקיר. “Why let good food go to waste,” she argued. Her husband was persuaded. “Go ahead and eat some and then I will as well,” he said. She ate and then so did he. “That was good,” she said. “But why did you tell me to eat first?” she asked. Her husband answered: “According to your שיטה, the guest was מתיאש and the food was now ownerless. But I have serious doubts about that.” “Nevertheless,” the wife said, “you ate from it after I did. Why?” The husband explained: “I simply followed the saying that whoever eats another’s food without permission should choke on the first slice.”
