בבא קמא ב

One year, רבי יהונתן אייבשיץ was asked to speak at a פורים סעודה. By chance, there was a מסכת בבא קמא on the table in front of him. רבי יהונתן opened the גמרא to the first דף and said ארבעה אבות נזיקין: השור והבור והמבעה וההבער. On this, תוספות ask: Why doesn’t the משנה say ארבעה אבות נזיקין הן, as it says in other places in the תלמוד? For example, the word הן appears in ארבעה ראשי שנים הן and ארבעה שומרים הן. The answer can be derived from מסכת פסחים, דף קיב, which states נזהה דתורא הן הן. Namely, that to chase away a שור המזיק one cries out הן הן. Therefore, the משנה in בבא קמא didn’t use the word הן, out of concern that the שור would hear it from the ארבעה אבות נזיקין and run away.
